For a foreign investor who wants to buy property or set up a company in Türkiye, the greatest risk is making decisions within an unfamiliar legal system and in an unfamiliar language. Our aim in this area is to make sure the investment is structured soundly before anything is signed, and managed properly afterwards.

Due diligence before a property investment

Before a sale, we review the title deed record of the property, any mortgages, attachments and annotations on it, its zoning status and its occupancy permit. Under Article 35 of Land Registry Law No. 2644, the acquisition of real estate by foreign nationals is subject to certain restrictions; we check at the outset whether the property is affected by them.

The sale process and land registry transactions

This includes drafting or reviewing promise-to-sell and sale agreements, securing the payment plan, the valuation report and following the transactions at the land registry office. Investors who are abroad can also complete transactions through a power of attorney.

Citizenship by investment

For a Turkish citizenship application through real estate investment, the eligibility of the property, the required documents and the annotations to be entered in the land register are planned together. Because the conditions change from time to time, every assessment is made against the regulations in force.

Company formation and corporate advisory

Foreign Direct Investment Law No. 4875 adopts the principle of equal treatment of foreign and domestic investors. The choice of company type, incorporation procedures, shareholders' agreements and the company's day-to-day legal matters are handled within the framework of Turkish Commercial Code No. 6102.

Managing the property

The purchase is only the beginning. Leasing, tenancy agreements, service charges and building management, taxes and official notifications must also be followed while the investor is not in Türkiye.

Single point of contact

An investment involves many authorities: the land registry, the tax office, banks, the migration authorities and notaries. The client speaks to one person, and receives regular written reports on which step is at which stage.

Frequently asked questions

Can I acquire Turkish citizenship by buying property?

Yes. A foreign national who acquires property of the value set by the regulation, and has an annotation entered in the land register that it will not be sold for three years, may apply for citizenship by way of exception (Regulation on the Implementation of the Turkish Citizenship Law, Article 20). As the minimum value changes from time to time, the current amount should be confirmed before the transaction.

Can foreign nationals buy property anywhere in Türkiye?

No. Acquisition is subject to reciprocity and statutory limits: property cannot be acquired in military exclusion and security zones, and there are limits on the total area per person (Land Registry Law, Article 35).

Do I need to be in Türkiye to set up a company?

No. The formation can be carried out under a power of attorney; a power of attorney issued abroad should be prepared at a Turkish consulate or certified by a notary with an apostille.
